No Judicial Review of Bulick Award

On December 30th 1997, Brother Ron Bulick responded to a house fire and received multiple injuries when he fell through a floor. He retired in 1999 and exactly 11 months later passed away.

As a result of efforts made by Mrs. Bulick and the Association the Coroners Office examined the case and in 2005 reported that his death was due to the injuries he sustained when he fell through the floor and therefore deemed "accidental". As a result of this finding, WSIB ruled his death work related and applied compensation. The Association then wrote the Corporation seeking that his AD&D benefit be paid to Mrs. Bulick. In 2007 the Corporation advised the Association that in their view all benefits had correctly been paid to Mrs. Bulick. Subsequently the Association filed a grievance and hearings took place in August and October of 2009 in front of Arbitrator William Kaplan. In October 2009 Arbitrator Kaplan sustained our grievance and ordered the Corporation to pay the AD&D benefit.

The Corporation advised the Association that they may be taking the decision to judicial review. The issue was taken to Council this week and we are very pleased to report that after a vote at Council, the case will not be judicially reviewed. The Executive Committee thanks and commends Council on their decision to do what was right for our fallen Hero and his Family. We would be remise if we did not thank and acknowledge the assistance of our Administration regarding this decision.
